Liability in commercial truck accidents

Accidents involving trucks are inherently more dangerous than other types of motor vehicle accidents for the simple reason that trucks are so much larger and heavier than other vehicles on the road. A commercial truck accident also adds an additional layer of legal complexity to a lawsuit to recover damages.

In a typical car accident caused by a negligent driver, the injured or the family of the deceased may recover compensation from the driver Negligent drivers are liable for any injuries or damages caused by their behavior. The court will review the driver's behavior, and if they are found negligent, the injured party will be entitled to damages, such as medical expenses, lost wages, and compensation.

Trucking accidents add an additional element of liability. If a person is injured in an accident caused by the driver of a commercial truck, the injured party may be able to recover compensation from the business in addition to the negligent driver. In some cases, other parties, such those who provide maintenance on trucks, may be held liable as well.

State and federal trucking regulations may also play roles in truck accident litigation. In an effort to curb truck driver fatigue and other dangers of commercial trucking, the government heavily regulates the commercial truck diving industry. Federal trucking regulations are strict and impose additional duties and obligations onto truck drivers, so these regulations may aid an injured party's case against a negligent truck driver.

Truck driving accidents are dangerous and traumatizing. An injured party or the family of the deceased can consult with an attorney to learn more about their legal options. An experienced attorney can offer guidance, advice and support through these difficult times.
